Exceptional Leave to Remain for persons with unclear identity
If your stay is being granted because your deportation cannot be carried out for reasons for which you are responsible, if you have caused the obstacle to deportation yourself by deceiving others about your identity or nationality or by giving false information, or if you do not take reasonable steps to fulfil the special obligation to obtain a passport, you will be granted Exceptional Leave to Remain for persons with unclear identity in accordance with Section 60b AufenthG (German Residence Act).
There is an overview of the actions that can reasonably be expected to be taken in order to obtain a passport or passport replacement. The list is not exhaustive.
Outlook
The periods of possession of an Exceptional Leave to Remain for persons with unclear identity may not be counted towards the required residence periods for a residence permit for well-integrated young people and adolescents or towards sustainable integration.
In addition, you are not permitted to engage in paid employment.
Please note
Once granted, an Exceptional Leave to Remain is only valid in Germany, expires by law when you leave Germany and may not be granted again under certain circumstances. This also applies if you are “only” travelling for a few hours to a neighbouring country (e.g. the Netherlands, Belgium, Switzerland). An Exceptional Leave to Remain does not entitle you to enter another country or to re-enter Germany.
